| Abstract: | Legislativní úprava režimu sbírek muzejní povahy jako součásti kulturních památek naší republiky, úpravu nakládání s nimi z hlediska soukromoprávních předpisů a modifikace této úpravy speciálními správními předpisy, tedy střet práva soukromého s veřejným, střet zájmu na ochranu vlastnického práva jednotlivce a soukromých právnických osob se státním zájmem na ochranu kulturního bohatství. V práci je poukázáno na jednotlivé judikáty, které významně ovlivnily tuto problematiku i postavení institucí, které zajišťují péči o naše kulturní dědictví. Dále je vylíčena podpora státu při nakládání s muzejními sbírkami, snaha zajistit jim zajistit co největší bezpečnost na naší, evropské i mezinárodní úrovni. Pojednáno je i o problematice navrácení neoprávněně uloupených či zabraných sbírek. Podrobně je rozepsána problematika nedostatků v postavení institucí spravující tyto sbírky i legislativní mezery v úpravě zákonů v této oblasti. |
| Abstract in different language: | descrition the legal regime of museum collections as part of the cultural heritage of our republic, their treatment by private law and modifications of this legal framework by special administrative legislation i.e. the conflict of private and public law, the conflict of the right to protection of private ownership and the interest of the state on protection of the cultural wealth. The thesis presents individual court decisions that substantially influenced this area of law and the position of institutions taking care of our cultural heritage. The discussed topics also include the support of the state in dealing with the museum collections with the aim to achieve the best possible security on national, European and international levels and the issue of returning stolen or illegally confiscated collections. The problems and insufficiencies of the legal regulation of this area of law is provided in detail. |
