| dc.description.abstract | Diplomová práce "Řešení investičních sporů z pohledu rozhodovací praxe mezinárodních rozhodčích soudů" se věnuje otázkám ochrany mezinárodních investic a možnostem řešení sporů z nich vznikajících. Obsáhle se zabývá definicí pojmu investice (na příkladech z rozhodovací praxe), jmenuje prameny mezinárodního investičního práva a v této souvislosti zvlášť pojednává i o interakci práva EU a bilaterálních smluv o ochraně investic. Z procesního hlediska se zabývá rozhodčím řízením, fungováním Mezinárodního střediska pro řešení sporů z investic (ICSID) a otázce precedentu. Pojednáno je i o lidských právech v kontextu mezinárodního investičního práva. Celá práce se snaží o propojení teoretických informací a příkladů z praxe, aby poskytovala ucelenou představu o problematice mezinárodní investiční arbitráže. | cs |

| dc.description.abstract-translated | The thesis on "Settlement of legal investment disputies in the decision-making practice of the international arbitration centers" deals with the protection of international investments and possibilities for solving disputes arising from them.It focuses on the definition of investment (based on examples from the decission-making practice), instruments used to protect the investment, protection regimes and sources of law. In adittion, it examnines the interaction between the EU law and bilateral agreements on investment protection. From the procedural point of view, it deals with the arbitral settlement of disputes, above all by the International Centre for Settlement of Investment Disputes (ICSID). One chapter i salso dedicated to examin the human rights in the context of the international investment arbitration as well as the role of precedent. The whole work is trying to link theoretical information and examples from practice, and thus provides a comprehensive view of issues of international investment. | en |
