| Abstract: | Diplomová práce se zabývá problematikou vedlejších doložek v závěti, jejichž úprava je obnovena v novém občanském zákoníku. Cílem práce je popsat a zanalyzovat tuto obnovenou úpravu v našem právním řádu. V první části práce nalezneme teoretické vymezení jednotlivých vedlejších doložek v závěti. Poté následuje historické vymezení vedlejších doložek v závěti v právních úpravách platných na našem území. Po této kapitole následuje popis a zhodnocení platné právní úpravy vedlejších doložek v závěti a instututů majících povahu vedlejších doložek v závěti. Poslední kapitola je věnována instututům nahrazujícím vedlejší doložky v závěti. |
| Abstract in different language: | The thesis focuses on clauses of lesser importance in testament, the adjustment of which is reestablished in the new Civil Code. The aim of the thesis is to describe and analyze this restored adjustment in our judicial code. In the first part of the thesis, we can find the theoretical determination of separate clauses of lesser importance in testament. Then, there is the historical determination of clauses of lesser importance in legal adjustments effective in our territory, followed by a part describing and assessing the current legal adjustment of clauses of lesser importance in testament and of institutes having the character of clauses of lesser importance in testament. The last part is about institutes replacing clauses of lesser importance in testament. |
