| Abstract: | Práce se zaměřuje na problematiku nesporných řízení po přijetí zákona č. 292/2013 Sb. o zvláštních řízeních soudních. V první části práce jsou rozebírány obecné znaky nesporných řízení. Další část práce je zaměřena na rozbor obecných ustanovení zákona č. 292/2013 Sb. o zvláštních řízeních soudních. V poslední část práce je věnována zvláštním řízením, jenž vznikla v návaznosti na věcné změny občanského práva, zavedené v důsledku rekodifikace soukromého práva. |
| Abstract in different language: | Thesis aims to special proceedings. The structure of the thesis follows from the description of non-contentious proceedings characteristics to general interpretation of the SPJ general provisions and analysis of particular special proceedings. The first part of the thesis is dealing with general characteristics of non-contentious proceedings that differentiate them from contentious proceedings according to the CPP. Furthermore the thesis is looking at the details of the general provisions §1-§30 of the SPJ that create the procedural framework of the special proceedings. With regard to the chosen topic, the thesis focuses only on those special proceedings that were adopted as a result of recodification of the Civil Code. In other words the main focus are the proceedings that had not been known to the civil proceedings law prior to the recodification. |
