| Abstract: | Diplomová práce pojednává o institutu dovolání v civilním procesu, z hlediska teorie práva zařazuje dovolání do systému opravných prostředků, dále rozebírá historické proměny tohoto institutu a jeho vývoj na území ČR. Praktická část práce je věnována současné legislativní úpravě dovolání a navazující judikatuře. Práce je zakončena úvahami de lege ferenda nad dovoláním, jeho současnou právní úpravou a jeho účelem v českém civilním procesu. |
| Abstract in different language: | This diploma thesis is about appelate review in czech civil procedure and can be divided in two parts. Part one is focused on theoretical and historical view of the subject, places it in order (in structure of Czech appeals) and points out the theoretical base of it. The historical part describes the evolution of appeals in Czech territory.The second part is focused on practical side of apellate review, describes current legislation and its comparison to previous one, which was valid until 31.12.2012. The second part also describes judications of the Supreme Court and findings of the Constitutional Court in context with apellate review and its recent chenges. The thesis ends with thoughts and reflections about appelate review, its function in Czech civil procedure and also reflections about the Supreme Court and visions what could possibly lead to an ideal situation in this area. |
