| Abstract: | Předmětem práce je analýza právního rámce oblasti omezení svéprávnosti člověka a dalších méně omezujících opatření, které přináší nový občanský zákoník účinný od 1. ledna 2014. Rigorózní práce se vypořádává s různými možnostmi, které mají soudy k dispozici při rozhodování o svéprávnosti osob trpících duševními poruchami, díky kterým nejsou schopni samostatného rozhodování. Klíčovým bodem je uchopení důležitosti nové právní úpravy na pozadí Úmluvy OSN o právech osob se zdravotním postižením. Cílem práce je popsat důležitost ochranné funkce institutu omezení svéprávnosti a dalších méně omezujících opatření a nastínit systematický přehled možných řešení, jak ochránit jedince, jejichž schopnost samostatného rozhodování byla narušena. |
| Abstract in different language: | The thesis focuses on the theme of person´s legal capacity and other less restrictive measures, which brings the new Civil Code, valid from January 1, 2014. It deals with various possibilities that nowadays the court may use towards the people suffering from a mental disorder that causes them the inability of independent decision-making. The thesis analyzes a legal dimension of the issue. The key point is to capture the importance of the new legislation based on the Convention on the Rights of Persons with Disabilities. The aim of this thesis is to describe the importance of the protective function of restriction legal capacity and less restrictive measures and outline a systematic overview of possible solutions on how to protect individuals whose ability to make decisions in legal relations is disturbed by mental disorders. |
