Abstract: | Práce nazvaná Zákaz použití síly a hrozby silou v mezinárodním právu a jeho nesporné výjimky se zabývá historickým vývojem doktríny bellum iustum a vývojem použití síly v mezinárodních vztazích. Přehledově je zpracována problematika použití síly v mezinárodních vztazích dle Společnosti národů i dle Pařížského paktu. Je v ní vysvětlena Stimsonova doktrína neuznávání či Drago-Porterova doktrína zákazu použití síly k vymáhání veřejných dluhů.. Věnuje se analýze a interpretaci jednotlivých pojmů uvedených v článku 2 odstavec 4 Charty OSN, zejména pojmům ozbrojený útok, mezinárodní vztahy, politická nezávislost a územní celistvost a pojmu síla. Dále se věnuje analýze a interpretaci článku 51 Charty OSN a donucovacím opatřením Rady bezpečnosti OSN dle kapitoly VII. Charty OSN. Práce obsahuje také definici hybridní války, Její součástí je případová studie použití síly v Iráku, Gruzii a na Ukrajině. |
Abstract in different language: | In this diploma thesis I address the issue of prohibition of threat and use of force in international law and its unequivocal exceptions. The work deals with the historical development of the doctrine of bellum iustum and development of recourse to force in international relations. It analyzes the problems of using force in international relations according to the League of Nations and the Pact of Paris. It explains the Stimson doctrine of non-recognition and Porter-Drago doctrine of prohibition of the use of force to recover public debts. It deals with the analysis and interpretation of terms used in Article 2 paragraph 4 of the UN Charter, especially the armed attack, international relations, political independence and teritorial integrity and the term force. Hereafter it deals with the analysis and interpretation of terms used in Article 51 of the UN Charter and Security Council enforcement action under Chapter VII of the UN Charter. It includes a case study of the use of force in Iraq, Georgia and Ukraine. In conclusion it countains definition of hybrid warfare. |
