| Abstract: | Předložená rigorózní práce poskytuje ucelený pohled na problematiku předběžných opatření vydávaných dle občanského soudního řádu, jako základu pro předběžná opatření ve věcech ochrany proti domácímu násilí. Práce popisuje jak postup vydání obecných předběžných opatření, tak i předběžných opatření ve věcech ochrany proti domácím násilí, včetně nebezpečného pronásledování. Autorka se v práci zaměřila na problematická ustanovení právního řádu a v rámci úvah de lege ferenda se snažila navrhnout nové inovativní a efektivnější řešení problematických ustanovení a možných vzniklých situací. Součástí práce jsou i přílohy, které jsou srovnáním podaných návrhů u okresních soudů v obvodu Krajského soudu v Ústí nad Labem a Krajského soudu v Plzni a zároveň jejich úspěšnosti. |
| Abstract in different language: | The submitted thesis provides compact view of the problematic of the preliminary measures, which were issued under the Code of civil procedure as a base of the regulation of the preliminary measures concerning the protection against domestic violence. The thesis describes not only the proceeding of issuance of the common preliminary measures but proceeding of issuance of preliminary measures concerning the protection against domestic violence as well, including dangerous chasing. The author focuses on problematic rules of law and in terms of considerations de lege feranda the author tried to suggest new, innovative and more effective solution to the problematic rules of law and to possible ensued situations. A part of this thesis are also appendices comparing the submitted motions by the district courts in district of the Regional court Ústí nad Labem and the Regional court Plzeň and their success. |
