| Abstract: | V této práci jsem rozebrala ustanovení § 142a o.s.ř. Lze shrnout, že důvody, pro které bylo toto ustanovení zařazeno do občanského soudního řádu, je možné označit za vysoce legitimní a spravedlivé. S možnými úskalími výkladu tohoto ustanovení se následná soudní praxe vypořádala způsobem, který lze považovat za vyhovující jak z pohledu žalobců (věřitelů), tak z pohledu žalovaných (dlužníků). Omezení, které toto ustanovení klade věřitelům, není nikterak nepřiměřené. Ochranu pak toto ustanovení v praxi přináší skutečně jen těm dlužníkům, kteří jsou toho ve shodě s úmyslem zákonodárce hodni, a neumožňuje, aby bylo nepoctivými dlužníky zneužíváno. |
| Abstract in different language: | The thesis deals with the institute of pre-trial appeal under Section 142a of Act No. 99/1963 Coll., Civil Procedure Code. According to this institute, the plaintiff´s claim for reimbursement of the costs of the proceedings is conditional on the prior sending of a pre-trial appeal to the defendant. In addition to the general description of the institute, the formal prerequisites for its use, the content of the pre-trial appeal and the consequences of its omission, this thesis focuses primarily on the application exceptions, i.e. the description of the cases where the courts grant the plaintiff reimbursement of the costs even if he did not send the pre-trial appeal to the defendant in advance. |
