| Abstract: | Diplomová práce se zabývá problematikou dokazování ve sporech z poskytování lékařských služeb. V práci se zaměřuji nejprve na obecnou problematiku dokazování v civilním řízení, poté na dokazování ve sporech z poskytování lékařských služeb a jeho specifika oproti obecné právní úpravě, včetně vysvětlení pojmu lege artis. V praktické části práce je pracováno s konkrétními příklady z praxe, ty jsou porovnány s teorií a je z nich vyvozen závěr. |
| Abstract in different language: | The thesis deals with the issue of evidence at disputes resulting from provision of medical services. In the thesis I focus on the general issue of evidence in the civil proceeding, then on issue of evidence at disputes resulting from provision of medical services and its specifics against general legislation, including an explanation of the term lege artis. In the practical part of the thesis is working with individual cases, these are compared with legal theory and then a conclusion is drawn from them. |
