| Abstract: | Diplomová práce se věnuje zvláštním řízením soudním a jejich hlavní právní úpravě, která je obsažena v zákoně č. 292/2013 Sb., o zvláštních řízeních soudních.Před přijetím tohoto zákona upravoval zvláštní řízení soudní zákon č. 99/1963 Sb., Občanský soudní řád. Zvláštní řízení soudní lze označit s určitými výjimkami za řízení nesporná. První část práce se zabývá komparací řízení sporného a nesporného a historickým vývojem nesporných řízení. Druhá část pokračuje analýzou obecné části zákona č. 292/2013 Sb., o zvláštních řízeních soudních. Poslední část diplomové práce se zabývá novými řízeními obsaženými v tomto zákoně. Z důvodu velkého množství zvláštních řízení soudních jsou předmětem diplomové práce pouze řízení, která před přijetím tohoto zákona svou úpravu neměla. |
| Abstract in different language: | The thesis deals with the special legal proceedings and their mainly legal regulation, which is contained in the Act No. 292/2013 Coll., on Special Legal Proceedings. Before the adoption of this Act, the special legal proceedings was regulated by the Act No. 99/1963 Coll., Code of the Civil Procedure. The special legal proceedings can be considered non-contensious with certain exceptions. The first part of the thesis deals with the comparison of the contensious and non-contensious proceedings and the historical development of the non-contensious proceedings. The second part continues with the analysis of the general part of the Act No. 292/2013 Coll., on Special Legal Proceedings. The last part of the thesis deals with the new proceedings contained in this Act. Due to the large number of the special legal proceedings, the subject of the thesis is only the proceedings which didn't have their legislation before the adoption of this act. |
