| Abstract: | Rigorózní práce se zabývá postavením soudního exekutora v České republice při výkonu exekuční činnosti prováděné dle zákona č. 120/2001 Sb., o soudních exekutorech a exekuční činnosti (exekuční řád) ve znění pozdějších předpisů. Dále vývojem exekučního řízení od roku 1918, srovnáním s dalšími právnickými profesemi a vlivem jiných řízení na exekuce, komparací s postavením soudních exekutorů ve vybraných zemích a rozborem nákladů exekuce. |
| Abstract in different language: | This rigorous thesis deals with the position of a court distrainer in the Czech Republic during the performance of a distraint procedure according to Act No. 120/2001 Coll., on court-appointed distrainers and distraining activities (Rules of Distraining) as amended. Further in his work, the author gives an overview of the history of a distraint procedure from 1918 onwards, a comparison to other legal professions and the influence of other proceedings on ongoing distraining proceedings. Last but not least, the thesis compares the position of a Czech court distrainer with its counterparts in several selected countries and brings a research of the costs of distraint procedures. |
