dc.description.abstractDiplomová práce se zabývá právní úpravou rozvodu manželství s mezinárodním prvkem. Cílem práce bylo především zmapovat dané téma po teoretické stránce. Podkladem práce byla zejména odborná literatura a právní předpisy. Za stěžejní metody práce můžeme považovat dedukci a komparaci. První kapitola je zaměřena na historický vývoj právní úpravy manželství na našem území, od počátků snah o kodifikaci občanského práva za vlády Marie Terezie až po současnost. Druhá a třetí kapitola vychází z účinného Občanského zákoníku z roku 2012. Druhá kapitola je věnována platné právní úpravě manželství obecně. Ve třetí kapitole je podrobně rozebrán rozvod manželství u nás. Ve čtvrté a páté kapitole se dostáváme k samotnému jádru tématu práce. Rozdělení do dvou kapitol je zásadní, jelikož rozvod s občanem EU se řeší především dle unijního práva, kdežto rozvod s občanem 3. země, se řídí dle ZMPS, případně mezinárodními smlouvami. Poslední, šestá kapitola poukazuje na nedostatky právní úpravy manželství a navrhuje jejich možná řešení.cs

dc.description.abstract-translatedThis thesis deals with the legal regulation of divorce of marriage with an international element. The goal of the thesis is to map the topic from the theoretical point of view. Literature and legal regulations are the main basis of this work. Deduction and comparison can be considered as the main methods implemented in the work. The first chapter focuses on the historical development of the legal regulation of marriage in our region, from the beginning of efforts to codify civil law during the reign of Maria Theresa to the present. The second and third chapters are based on the effective Civil Code of 2012. The second chapter is devoted to the valid legal regulation of marriage in general. The third chapter discusses in detail the divorce of marriage in our country. In the fourth and fifth chapters we reach the very core of the topic. The division into two chapters is essential, as divorce with an EU citizen is primarily dealt with under EU law, whereas divorce from a third country citizen is governed by the ZMPS (Act Governing Private International Law) or international treaties. The last, sixth chapter points out the shortcomings of the legal regulation of marriage and suggests possible solutions.en
