| Abstract: | Tato diplomová práce se zabývá problematikou rozhodování o nákladech řízení v civilním procesu. Jde o zvláštní část občanského práva procesního, která je veřejností stále opomíjena, přestože o nákladech řízení musí být téměř v každém případě rozhodnuto. Práce je členěna na čtyři části. První část se zaměřuje na pojem, funkci a druhy nákladů řízení. V další části je popsána část právní úpravy nákladů řízení. Třetí část se zaměřuje na náhradu nákladů řízení, a je zde i do hloubky zpracováno rozhodování o nákladech řízení. Na konci práce je provedena komparace odlišnosti české a rakouské úpravy náhrady nákladů řízení. Cílem práce bylo poodkrýt tuto problematiku nejen za pomoci zákonů, judikatury a odborné literatury, ale i v podobě příkladů, které do problematiky vnáší lidský faktor. Práce se ubírá vesměs popisným stylem s částmi subjektivně zabarvených komentářů, na jejichž aplikaci byla použita metoda zkoumání opírající se o kvalitativní metodu, jejímž cílem je odkrýt význam daných informací. |
| Abstract in different language: | The thesis deals with the issue of court decisions on costs of civil proceedings. It is a special part of civil procedural law that is still neglected by the public, although the costs of the proceedings must be decided in almost every case. The thesis is divided into four parts. The first part focuses on the concept, function and types of the procedural costs. The next part deals with the description of the legal regulation of costs. The third part focuses on the reimbursement of costs, and it also elaborates on the decision-making on the costs of the civil proceedings. The final part of the work offers a comparison of the differences between the Czech and Austrian regulation of the reimbursement of the proceedings' costs. The aim of the work was to reveal this issue not only with the aid of law, case law and professional literature, but also through the form of examples bringing the human factor to the issue. The work follows a generally descriptive style with parts of subjectively colored comments, which use is based on the qualitative research method, with the aim revealing the meaning of the information. |
