| Abstract: | Tato diplomová práce se zabývá hromadnými žalobami. Kromě úvodu a závěru je práce rozdělena do čtyř po sobě jdoucích kapitol. Nejprve je v této práci představen koncept hromadných žalob s poukazem na jejich účel a výhody, ale také představení argumentů hovořících o možných rizicích, která s sebou hromadné žaloby přinášejí a možnosti jejich zneužití. Dále je popsán a rozveden rozdíl mezi jednotlivými druhy hromadných žalob. Pro náležité uchopení problematiky je stručně shrnuta globální i česká historie tohoto instrumentu s poukazem na jeho vznik a vývoj. V následující části této práce je přiblížena současná legislativní situace v České republice. Pozornost je věnována současnému využití tohoto procesního institutu v různých částech světa s důrazem na představení hromadných žalob v evropských státech a hromadných žalob ve světle právního řádu Spojených států. Dále je představen vývoj legislativy na úrovni Evropské unie. V poslední kapitole jsou popsány a hodnoceny aktuální legislativní návrhy v České republice. |
| Abstract in different language: | This diploma thesis deals with class actions. Apart from the introduction and conclusion, the work is divided into four consecutive chapters. In the beginning, the concept of class actions is introduced with references to their purpose and benefits. Arguments about the possible risks that come with class actions and the possibilities of their abuse are also discussed. Next, the difference between the various types of class actions is described and explained. In order to properly grasp the issue, the global and Czech history of this instrument is briefly summarized with reference to its origin and development. This is followed by approaching the current legislative situation in the Czech Republic. Attention is paid to the current use of this procedural institute in various parts of the world with emphasis on the presentation of class actions in European states and class actions in light of the United States legal order. In the latter part of this work, the legislative development at the European Union level is presented. In the last chapter, the current legislative proposals are described and evaluated. The aim of these proposals is to introduce legal regulation of class actions in the Czech Republic. |
