| Abstract: | Tématem této diplomové práce je "Řízení ve věci přestupků se zaměřením na zahájení řízení, průběh řízení a rozhodnutí o přestupku". Cílem bylo poskytnout náhled na procesněprávní rovinu přestupkového řízení a současnou komparaci ve vybraných institutech s dřívější úpravou. Hlavní zaměření vyplývá z názvu práce, tedy zahájení, průběh a rozhodnutí o přestupku. Na začátku práce jsou ve dvou kapitolách rozebrány subjekty řízení, pojem a právní úprava přestupkového řízení. V další kapitole je již rozebrána první fáze, a to fáze před zahájením řízení. Následně 4 až 6 kapitola je pak stěžejní částí diplomové práce. Obsahuje zahájení řízení, průběh řízení jako například ústní jednání a celá práce je zakončena rozhodnutím o přestupku. |
| Abstract in different language: | The topic of this diploma thesis is "Proceedings in the matter of misdemeanors with a focus on the initiation of proceedings, the course of proceedings and decisions on misdemeanors". The aim was to provide an insight into the procedural level of misdemeanor proceedings and the current comparison in selected institutes with the previous regulation. The main focus follows from the title of the work, ie the commencement of the course and the decision on the offense. At the beginning of the work, the subjects of the proceedings, the concept and legal regulation of misdemeanor proceedings are discussed in two chapters. In the next chapter, the first phase is discussed, namely the phase before the commencement of the proceedings. Subsequently, chapters 4 to 6 are the main part of the diploma thesis. It includes the commencement of proceedings, the course of proceedings such as oral proceedings and the whole work is concluded by a decision on the offense. |
