Abstract: | Cílem diplomové práce je zpracovat a zhodnotit nové změny institutu dovolání provedené novelou občanského soudního řádu, která je účinná od 1. ledna 2013. Cílem těchto změn je zrychlení dovolacího řízení, snížení počtu podaných dovolání a sjednocení rozhodovací praxe Nejvyššího soudu. Komparací předchozí a současné právní úpravy dovolání se pokusím zjistit, zda se stanovené cíle podaří naplnit. Snažím se charakterizovat nejdůležitější změny týkající se dovolání, které novela přinesla a jejich vliv na dosažení stanovených cílů zákonodárců. Dovolání je svou povahou mimořádný opravný prostředek, který umožňuje zásah do pravomocného rozhodnutí odvolacího soudu. K rozhodování o dovolání je příslušný jedině Nejvyšší soud. |
Abstract in different language: | The attempt of the diploma thesis is to elaborate and evaluate the present changes of appellate review institute made by the amendment of Civil Procedure Code, which came into force on 1st January 2013. The attempt of these changes is to accelerate the appellate review procedure, reduce the number of the files concerning appellate reviews and to unify the decision-making practice of the Supreme Court. By the comparison of the preceding and present law of appellate review, I will attempt to find out if the set goals are possible to fulfill. I will try to characterize the most important changes concerning the appellate review, what the amendment brought and what is the influence of these changes on accomplishment of the set goals of the legislators. The appellate review is an extraordinary remedy, which makes possible to oppose the effective decision of the court of appeal. For decision making about the appellate review it is only the Supreme Court who has the jurisdiction. |
