| Abstract: | Práce se zabývá problematikou mezinárodního rozhodčího řízení jako metody řešení sporu. Poskytuje srovnání s ostatními metodami řešení sporů, zejména tzv. alternative dispute resolution, definování pojmu fenoménu rozhodčího řízení, teoretických koncepcí a pojmových znaků. Dále se práce zabývá problematikou právní úpravy rozhodčího řízení v mezinárodním měřítku, dále pak v České republice a Velké Británii. Druhá polovina práce se zabývá problematikou klíčových elementů rozhodčího řízení; rozhodčí smlouvy a rozhodčího nálezu, včetně jeho uznání a výkonu. Na závěr práce shrnuje vliv OSN na podobu mezinárodního rozhodčího řízení tak, jak ho známe dnes. |
| Abstract in different language: | The thesis deals with an issue of the international commercial arbitration as a method of dispute resolution. It provides a comparison of arbitration to other dispute resolution methods, mainly those know as "alternative dispute resolution". The thesis then defines the phenomena of arbitration, its main theories and characteristics. It deals with the issue of of law applicable to the international commercial arbitration, both on international level and domestic level, specifically in the Czech Republic and The United Kingdom. The second half of the thesis contains chapters about key elements of the international commercial arbitration; arbitration agreement and arbitral award, as well as the issue of recognition and enforcement of such an award. The last chapter studies the influence of the UN to contemporary international commercial arbitration. |
