| Abstract: | Článek analyzuje úpravu obsaženou v československé ústavní listině z roku 1920 o tom, že soudní moc v oblasti trestní vykonávají vedle soudů i jiné orgány, a to podle předpisů o trestním řízení policejním nebo finančním. Rozebírá teoretické koncepce přístupu k té činnosti veřejné správy, která spočívá v projednávání a trestání přestupků a jiných protiprávních činů, a jejím vztahům k trestnímu řízení soudnímu. Věnuje se změnám, ke kterým došlo v oblasti přestupkového práva v důsledku řazení projednávání přestupku mezi případy tzv. trestních obvinění dle Úmluvy o ochraně lidských práv a svobod. |
| Abstract in different language: | The article analyzes legislation contained in a constitutional charter of Czechoslovakia from 1920 which defines that judiciary can also be exercised by other bodies as well as courts. This rule can be found in regulations of police or financial criminal procedure. The article anatomizes theoretical concepts of aprroach to the activity of public administration which consists in hearing and punishment of offenses and other unlawful acts, and to her relation to the judicial criminal procedure. The article also deals with the changes that occured in misdemeanour law due to inclusion of hearing of administrative offenses into cases of so-called criminal charges according to the European Convention on Human Rights. |
