| Abstract: | Zákon nijak samostatně neřeší náklady řízení v rámci excindačních žalob a soud aplikuje při rozhodování obecná ustanovení o náhradě nákladů řízení, primárně dle § 142 o.s.ř., tj. rozhoduje dle zásady úspěchu ve věci, případně dle § 143 o.s.ř. Snahou žalovaných je pak nalézt dostatečnou argumentaci proto, aby soud náklady řízení moderoval dle § 150 o.s.ř. Článek se tak snaží přiblížit možnosti řešení v rámci rozhodnutí soudu ohledně povinnosti uložit jedné ze stran náhradu nákladů řízení a poukazuje na nedostatečnou právní úpravu. |
| Abstract in different language: | The Act doesn´t independently deal with the costs in the exclusion proceedings within the scope of excise actions and the court applies general provisions on reimbursement of costs of proceedings, primarily according to § 142 of the Code of Civil Procedure, i.e. decides according to the principle of success in the case, or according to § 143 of the Code of Civil Procedure. The defendants then strive to find sufficient arguments for the court to moderate the costs of the proceedings pursuant to Section 150 of the Code of Civil Procedure. The article thus seeks to approach the possibilities of resolving the court's decision on the obligation to order one of the parties to pay the costs of the proceedings and points to the lack of legislation. |
