Abstract: | Služebnosti jsou věcným právem, které má dlouhou historii a tradici. Jedním z nejtypičtějších představitelů tohoto právního institutu jsou služebnost stezky, průhonu a cesty, jejíž historie sahá až do období římského práva. Příspěvek uvede tuto služebnost v kontextu historického vývoje od dob justiniánského práva, přes období raného feudalismu, platnosti obecného zákoníku občanského až po současnou úpravu v České republice. |
Abstract in different language: | Servitudes are a right in rem that has a long history and tradition. One of the most typical repre-sentatives of this legal institute is servitudes of pathway, of the passage of cattle and driveway, the history which dates to the period of Roman law. The article introduces this ministry in the context of historical development from the time of Justinian's law, through the period of early feudalism, the validity of the General Civil Code to the current regulation in the Czech Republic. |
