| Abstrakt: | Má diplomová práce na téma Podnikání cizinců na území České republiky je členěna na dvě základní části. Historicko-teoretická část se zaměřuje především na ochranu lidských práv. Dále se tato část věnuje vnitrostátním zákonům, které zahrnují pojem cizinec a tyto předpisy jsou seřazeny chronologicky. Tím jsou informace o těchto zákonech pro čtenáře pochopitelnější a dle mého názoru i zajímavější. Další část práce definuje základní pojmy vnitřní trh Evropské unie, cizinec, cizinecké režimy, cizinecký zákon a podnikání. Následující část popisuje pobyt a jeho jednotlivé druhy pro občana Evropské unie, jeho rodinného příslušníka a občana ze třetích zemí. Pro každou z těchto osob totiž jsou dány jiné podmínky pro vstup a pobyt na území České republiky. Poslední kapitola teoretické části je kapitola podnikání a zaměstnávání cizinců na území České republiky. S touto kapitolou souvisejí i další kapitoly ohledně právní úpravy tohoto tématu. Další částí práce je praktická část. Praktická část práce se snaží nalézt odpovědi na otázky, zda se projevil vstup České republiky do Evropské unie nárůstem cizinců s pobytem na území České republiky, zda dochází ke snížení počtu zahraničních osob v České republice v důsledku hospodářského poklesu, zda vzrostl počet podnikatelů s živnostenským oprávněním po vstupu České republiky do Evropské unie a zda jsou cizinci pobývající na území České republiky rozmístěni rovnoměrně. Závěr práce tvoří právě interpretace odpovědí na tyto otázky. V závěru je také zhodnocen současný zákon o pobytu cizinců na území České republiky a navržena jeho nová úprava. |
| Abstrakt v dalším jazyce: | My diploma thesis on the topic Legal regulations of enterprise of foreigners in the Czech Republic is divided into two main parts. The historical ? theoretical part is concentrated especially on protection of human rights. Afterwards this part takes heed of national laws, which include term foreigner and these regulations are in chronological order. This makes information about these laws more understandable for the reader and in my opinion it makes information more interesting. Another part of my thesis defines the basic terms of the internal market of the EU, foreigner, aliens regres, aliens law and enterprise. The following part describes foreigners residency and its individual species for a European Union citizens, their family member and citizens from third countries. For each of these people are given different conditions for entry and residence in the Czech republic. The last charter of the historical ? theoretical part is a chapter about enterprise and employment of foreigners in the Czech republic. This chapter is connected with another chapters about legal regulations of this topic. The other main part of thesis is practical part. The practical part of work is trying to find answers to the questions if joining of Czech republic into the European union showed an increase of foreigners with residence in the Czech republic, if there is a reduction in the number of the number of foreigners in the Czech republic due to economic downturn, if the number of entrepreneurs with trade licence has increased after the Czech republic joined into the European union and if the foreigners staying in the Czech republic are harmoniously arranged. The conclusion of thesis is interpreting the answers to these questions. In the conclusion is also evaluates the current Law of the residence of foreigners in the Czech Republic and is suggested a new amendment of this law. |
