| Abstract: | Tato diplomová práce má za cíl objasnit účel a možnosti využití zástavního práva, zaměřit se přitom na zajišťovací a uhrazovací funkci a zároveň poukázat na novinky, které současná právní úprava zavedla občanským zákoníkem č. 89/2012 sb. Práce zkoumá především změny v možnostech realizace zástavního práva a úpravy ve vzájemných právních vztazích jednotlivých účastníků. Zabývá se vznikem, aplikací i zánikem zajišťovací a uhrazovací funkce zástavního práva. |
| Abstract in different language: | This thesis aims to explain the purpose and options of the use of lien, primarily focusing on hedging and reimbursing function. And also pointing out to news introduced by contemporary law. It is mostly based on the new Civil Code no. 89/2012 , which introduced important changes. This work investigates primarily changes in options of realization of right of lien and adjustments in mutual legal relations of the participants. It is dealing with formation, aplication and completion of hedging and reimbursing function of lien |
