| Abstract: | Diplomová práce se zabývá problematikou podání v rámci civilního procesu jakožto základním institutem procesního práva a zároveň nejčastějším procesním úkonem účastníků řízení. Hlavním cílem této práce je podat ucelený výklad o právní úpravě tohoto institutu. V úvodní části je pojednáno obecně o procesních úkonech, aby bylo zřejmé, kam se řadí samotný institut podání. Následující kapitoly se věnují formám a náležitostem podání, a to jak obecným, tak zvláštním. Jestliže nějaká náležitost chybí, pak je podání vadné a následuje proces odstranění vad. V práci nechybí ani kapitola věnovaná druhům podání, přičemž nejznámějším typem podání je žaloba. |
| Abstract in different language: | The diploma thesis deals with the problematics of submission in civil procedure as its general legal institute and also the most common procedural act of involved parties. The main aim of this thesis is to create coherent comment on the legal regulation of this institute. At the beginning, the procedural acts are discoursed as the whole in order to show where the place of submission is. The following part deals with forms of submission and its elements both general and specific. If there are some of the elements missing, then the submission is defective and the process of elimination of defects is following. The thesis as well includes a chapter about types of submission where the well-known type of submission is action. |
