Abstract: | Diplomová práce pojednává o výkonu rodičovské odpovědnosti po rozvodu manželství. Cílem práce je shromáždit informace o tom, jak vypadá péče o nezletilé dítě po rozvodu jeho rodičů, a jaká možná řešení znamenají co nejmenší zásah do života dítěte. První kapitola se věnuje vymezení pojmu rodičovské odpovědnosti. V této části práce je definována rodičovská odpovědnost, vysvětlena změna pojmů v rámci stávající právní úpravy, jsou zde také vyjmenovány složky, které rodičovská odpovědnost zahrnuje a jak je vykonávána. V druhé kapitole je vymezena právní úprava rozvodu v ČR a jeho následky především vůči nezletilým dětem. Třetí kapitola je stěžejní částí práce a věnuje se problematice svěření dítěte do péče. Jsou zde rozebrány jednotlivé modely porozvodové péče a způsoby, jakými je dítě po rozvodu rodičů vychováváno, jak je o něj pečováno, a jaké faktory toto ovlivňují. Část této kapitoly se zaměřuje na koncept nejlepšího zájmu dítěte, který je při rozhodování o záležitostech, které se dítěte týkají, klíčovou zásadou. Poslední kapitola se zabývá stručným popisem situací, kdy se do otázek poměrů k nezletilému dítěti po rozvodu dostává mezinárodní prvek, z části se pak věnuje problematice mezinárodních únosů dětí. |
Abstract in different language: | This diploma thesis deals with a retain of a parental responsibility after divorce. The aim of the thesis is to gather information about how the custody of the child after the divorce looks like, and which way of an arrangement when the marriage is divorced presents the least possible interference with life of the child. The introductory part of the thesis deals with delimination of parental responsibility. This part includes the definition of a parental responsibility, explanation of evolution of the terms in current regulatory framework, a list of the components that parental responsibility includes and how it is retained. The second chapter defines the legal regulation of divorce in the Czech Republic and its consequences especially in relation to minor children. The main part of the thesis is the third chapter that deals with the issue of child custody. It analyses the models of custody after the divorce, as well as the forms of how the child is raised and what factors influence that. Part of this chapter is adressed to a concept of the best interests of the child. It presents a fundametal principle underlying the decision-making concerning the circumstances of the child after the divorce. The last chapter deals with a brief description of situations when an international element within the issue of custody of a minor child after divorce is included. The chapter also partly deals with the issue of international kidnapping of a child. |
