| dc.description.abstract | Diplomová práce se zabývá staronovým institutem práva stavby, který do právního řádu České republiky opětovně přináší zákon č. 89/2012 Sb., občanský zákoník, ve znění pozdějších předpisů. Z důvodu přehlednosti a systematiky se autor této práce rozhodl pro koncepční uspořádání celého tématu do čtyř základních kapitol. První z nich obsahuje vymezení základního pojmosloví a historickoprávní vývoj práva stavby. Druha kapitola je následně věnována způsobům nabývání práva stavby a jeho vzniku. Ve třetí kapitole je konkretizován obsah vztahu vlastníka pozemku a stavebníka, tedy jaká práva a povinnosti z právního institutu práva stavby plynou. Poslední z kapitol se zabývá pozbýváním práva stavby a jeho relativním a absolutním zánikem. Cílem této práce je komplexní analýza institutu práva stavby. V souvislosti s takovou je pak nezbytné osvětlení základních úskalí práva stavby, jelikož ačkoliv je právo stavby institutem staronovým, vyvstává, při nejmenším alespoň v teoretické rovině, celá řada sporných otázek, na které stále existují nejednotné názory. Z takového důvodu je cílem práce rovněž alespoň ve většině případů, v nichž jednotný názor neexistuje, poskytnout komparaci těchto různých názorů a zároveň též poskytnout názor vlastní. | cs |

| dc.description.abstract-translated | The thesis is focused on a legal institute, which is the right of superficies in accordance with Act No. 89/2012 Coll, the Civil Code, as amended. For reasons of clarity and systematics, the author of this thesis decided to divide the whole thesis into four main chapters, which are: the concept and historical roots of right of superficies, the acquisition of right of superficies, specification of the content of the relationship between the owner of the tract of land and the builder and cession of the right of superficies. The goal of this work is a comprehensive analysis of the institute of right of superficies. In connection with such analysis, it is necessary to explain the main problems of the right of superficies which arise, although the right of superficies is a well-known ancient institute. There are, at least on theoretical level, several disputable issues on which there is not an undifferentiated doctrinal opinion in place. For this reason, it also remains, at least in the majority of cases where there is no consistent doctrinal opinion in place, the objective of the thesis to provide a comparison of these opinions, as well as to provide the opinion of the author. | en |
