| Abstract: | Život a zdraví - dva pojmy neodmyslitelně spojené s existencí člověka. Hodnoty, bez kterých by nebylo hodnot dalších, kterými jsou svoboda, důstojnost a nedotknutelnost. Tyto principy prostupují právem na tělesnou a duševní integritu a právem na ochranu před zásahy do tohoto práva. S rozvojem moderních společností vstupuje do popředí autonomie vůle jedince před zájmy společnosti. Není tomu jinak ani v případech, kdy jsou život a zdraví ohroženy, ať už v podobě vyjádření vůle pro eventuální zásahy v budoucnu (dříve vyslovená přání, evidence v národních registrech apod.), či bezprostředně před zákrokem (informovaný souhlas). Ke všem zásahům se ovšem výslovný souhlas nevyžaduje. Právo rozhodnout, jaké dispozice budou s tělem fyzické osoby prováděny spadá též do kategorie práv osobnostních, neboť lidské tělo, ani jeho části, byť byly od těla odděleny nejsou věcí, a tudíž až na výjimky nemohou být předmětem práv majetkových. |
| Abstract in different language: | Life and health - key concepts inherent to man. Values which are prerequisites for freedom, dignity and untouchability. Principles which pervade the right for physical and spiritual integrity and its protection. In modern societies, the will of an individual predominates over interests of the society. This holds true also if life and heath are threatened either by an expression of will of a future interference (wishes expressed beforehand, records in national registry etc.) or immediately before an interference (an informed consent). However, not every interference requires an explicit consent. The right to determine the destiny of the body of a legal person belongs to the category of personal rights because neither the human body nor its parts, even detached ones, are legal properties and hence can not be the matter of the property rights. |
