| Abstrakt: | Svobodná vůle je jedním z nejstarších filozofických témat jež provází lidstvo již tisíce let. málokteré téma se stalo předmětem takového množství filozofických sporů a pečlivému zkoumání jako svobodná vůle. Přestože je svobodná vůle ve vědeckých kruzích problematikou hojně reflektovanou , většina lidí jež po světě chodí nad otázkou svobodné vůle nikdy nepozastaví. Představa toho že by naše vůle nebyla svobodná a že by naše rozhodnutí byly pouhým výsledkem předem daný deterministických příčin je pro většinu z nás absolutně neuchopitelná. Je tomu ovšem skutečně tak? Jsme opravdu nadání svobodnou vůlí a jsme tak v naší činech a rozhodnutí svobodní? Přiblížení odpovědí na tyto otázky bude tématem této práce. Problému svobodné vůle napříč dějinami věnovalo mnoho významných filozofů i vědců a já samozřejmě nepředpokládám že bych ve své práci téma svobodné vůle / ne svobodné vůle vyřešil. Avšak chtěl bych svojí prací představit a přiblížit tuto problematiku čtenáři a popsat důležité souvislosti ve vztahu k právní odpovědnosti |
| Abstrakt v dalším jazyce: | In my thesis The Law and Philosophy aspects of Free Will, I will focus on the question of, if what we call free will is really that what we imagine when thinking about the concept and what this means for us. The matter of free will has been looked into and reflected upon for thousands of years. Until last century, it was a strictly philosophical topic, because it was not possible to examine it using different methods than those of philosophy and logic. The advance that happened in the last decades in the fields of science and technology however, allowed us to look into the cognitive processes that go into making decisions. The goal of this thesis is not to uncover the secrets that humanity has been trying to uncover for the past few years, but I will try to examine the issue of free will and its impact on moral and legal accountability. In my thesis, I will first focus on the question of what free will is. Then, I will look at free will through the eyes of philosophical theory like determinism, that believes that all events are predetermined and that the present is determined by the past, and the future will be determined by the present. In this theory, human choices are predetermined and there is no way to escape this cycle. I will also focus on theories that have a different point of view on this topic, such as Indeterminism, Libertarianism, Compatibilism and Incompatibilism. Then I will analyse free will from a more scientific perspective, through modern scientific experiments, that will hopefully allow us to delve deeper into the human brain and into what we call the free will. After that, I will define the relation of moral and legal accountability and free will. There are different types of moral accountability, but I will look into the basic and the most common ones. I will compare these concepts of accountability with what different philosophical movements tell us about free will. Mainly, I will focus on how these theories of accountability will deal with the philosophy of determinism and the idea of a non-existent free will. In relationship to that,I will look into the theory of punishment and the theories of justifying punishment. I will look into Retributivism and Consequentialism and their types. I will also compare these theories to what we have learned in the previous chapter and about the inability to escape the cause and effect loop and accountability. |
