| Abstract: | Rigorózní práce se zabývá problematikou důkazního břemene a jeho přenesením ve vybraných sporech. V rámci své práce se nejprve zaměřuji na obecnou problematiku dokazování v civilním soudním řízení, poté na obecnou právní úpravu důkazního břemene, a to včetně břemene tvrzení a vysvětlovací povinnosti strany nezatížené důkazním břemenem. Stěžejní část práce je pak věnována problematice přenesení důkazního břemene, a to jak na základě zákona, tak i v ostatních případech. |
| Abstract in different language: | This rigorous thesis deals with the issue of the burden of proof and its reversing in selected disputes. In the rigorous thesis I focus on the general issue of evidence in the civil proceeding, then on general issue of the burden of proof, including the burden of claim and explanatory obligation of the party, which is not encumbered by the burden of proof. The main part of the rigorous thesis deals with the issue of reversing the burden of proof on the basis of the law, as well as in other cases. |
