| Abstract: | Diplomová práce je věnována problematice důkazního břemena v civilním soudním řízení. Cílem autorky je komplexní představení důkazního břemena a poukázání na některé jeho sporné aspekty. Diplomová práce je členěna do devíti kapitol včetně úvodu a závěru. V druhé kapitole diplomové práce je pojednáno o civilním soudním řízení a vybraných zásadách, jež se v řízení zpravidla uplatňují. Dále je nastíněna teoretická koncepce pojmů "procesní povinnost" a "procesní břemeno". Kapitola třetí se zabývá otázkou míry důkazu. Druhá část této kapitoly je zaměřena na objasnění pojmu vnitřního přesvědčení soudce. Čtvrtá kapitola představuje stěžejní část práce. Jejím cílem je důkladné rozebrání pojmu důkazního břemena, rovněž jako jeho vnitřní struktury. Podstatná část této kapitoly je věnována termínu non liquet a metodám překlenutí tohoto stavu. V páté kapitole je pojednáno o pojmu břemena tvrzení. Šestá kapitola je věnována otázce dělení důkazního břemena. Je rozebírána povaha a obsah základního pravidla dělení důkazního břemena. Druhá část kapitoly je zaměřena na zvláštní pravidla dělení důkazního břemena; tedy výslovná zákonná ustanovení, vyvratitelné zákonné domněnky a soudcovské dotváření pravidel dělení důkazního břemena. Sedmá kapitola představuje stručný vhled na problematiku důkazní nouze. Je v ní rozebírán informační deficit a vysvětlovací povinnost strany nezatížené důkazním břemenem. Osmá kapitola pojednává o francouzském pojetí civilního soudního řízení, rovněž jako o tamní úpravě důkazního břemena. |
| Abstract in different language: | The diploma thesis is devoted to the issue of the burden of proof in civil court proceedings. The aim of the author is to present the burden of proof in a comprehensive way and to point out some of its controversial aspects. The thesis is divided into nine chapters, including the introduction and the conclusion. The second chapter of the thesis deals with civil court proceedings and selected principles that are usually applied in the proceedings. It also outlines the theoretical concept of the concepts of "procedural obligation" and "procedural burden". Chapter three deals with the question of the standard of proof. The second part of this chapter is aimed at clarifying the concept of the judge's inner conviction. The fourth chapter is the central part of the thesis. It aims at a thorough discussion of the concept of the burden of proof, also as its internal structure. A substantial part of this chapter is devoted to the term non liquet and methods of bridging this. The fifth chapter discusses the concept of the burden of proof. The sixth chapter is devoted to the question of the division of the burden of proof. The nature and content of the basic rule of the division of the burden of proof is discussed. The second part of the chapter focuses on the special rules of burden of proof; that is, express statutory provisions, rebuttable statutory presumptions and judicial refinement of burden of proof rules. Chapter Seven provides a brief insight into the issue of evidentiary exigency. It discusses the information deficit and the explanatory duty of the party not burdened with the burden of proof. Chapter eight discusses the French concept of civil procedure, as well as the French rules on the burden of proof. |
