| Abstract: | Tato diplomová práce s názvem "Koncentrace, její funkce a důsledky ve sporném řízení" je zaměřena na podrobné seznámení čtenáře s koncentrační zásadou. První úvodní kapitola představuje civilní proces, je zde rozebrán pojem civilního procesu včetně jeho pojmových prvků, druhů a principů. Následující kapitola je věnována vývoji právní úpravy koncentrace v českém civilním procesu. Ve třetí kapitole práce přechází k samotnému jádru, a to k charakteristice institutu koncentrace. Další část práce již pojednává o současné právní úpravě koncentrace řízení, kde se důkladně věnuji možnostem užití koncentrace, jejím podmínkám a výjimkám. V neposlední řadě uvádím, jaké jsou důsledky zkoncentrování řízení. Cílem práce je charakterizovat zásadu koncentrace řízeni, popsat její vývoj, účel a důsledky v českém civilním procesu. Závěrem rozvíjím úvahy de lege ferenda a shrnuji její obsah. |
| Abstract in different language: | This thesis, entitled "Concentration, its function and consequences in contentious proceedings", aims to provide the reader with a detailed introduction to the principle of concentration. The first introductory chapter introduces civil procedure and discusses the concept of civil procedure including its conceptual elements, types and principles. The following chapter is devoted to the development of the legal regulation of concentration in Czech civil procedure. In the third chapter, the thesis moves to the very core, namely the characteristics of the institute of concentration. The next part of the thesis deals with the current legal regulation of concentration of proceedings, where I thoroughly discuss the possibilities of using concentration, its conditions and exceptions. Last but not least, I consider the consequences of concentration of proceedings. The aim of the thesis is to characterize the principle of concentration of proceedings, describe its development, purpose and consequences in Czech civil procedure. Finally, I develop de lege ferenda considerations and summarize its content. |
