| Abstract: | Práce se soustředí na téma řízení o likvidaci pozůstalosti. Hlavním cílem bylo podat ucelený a systematický výklad řízení, který bude doplněn o praktický pohled a judikaturu. První část práce je věnována hmotněprávní úpravě s cílem položit právní základ pro možnost procesního výkladu. Další část obsahuje popis řízení od jeho zahájení po skončení. Závěrečné kapitoly pojednávají o komparaci s cizí právní úpravou a o úvahách de lege ferenda. |
| Abstract in different language: | The thesis focuses on the topic of estate liquidation proceedings. The main aim was to provide a comprehensive and systematic interpretation of the procedure, which will be supplemented by practical insight and case law. The first part of the thesis is devoted to the substantive law in order to lay the legal basis for the possibility of a procedural interpretation. The next part contains a description of the proceedings from their initiation to their conclusion. The final chapters deal with comparisons with foreign legislation and de lege ferenda considerations. |
