dc.description.abstractPráce pojednává jednak o druzích nákladů řízení civilního řízení sporného a obecné povinnosti k jejich náhradě podle základních civilně procesních pravidel, jakož i o náhradě nákladů v řízení o zrušení a vypořádání spoluvlastnictví, které je řazeno do zvláštní kategorie tzv. iudicium duplex. Pozornost je v textu práce věnována nejprve pojmu nákladů řízení, následně pak výčtu jednotlivých druhů nákladů v civilním řízení sporném přicházejíc v úvahu a jejich rozboru, dále pravidlům, podle kterých je o právu na náhradu nákladů řízení rozhodováno, náhradě nákladů řízení v řízení o zrušení a vypořádání spoluvlastnictví a porovnání presumovaného dopadu do rozhodování o nákladech řízení v tomto typu řízení s ohledem na navrhovanou dikci civilního řádu soudního. Předmětná právní problematika je též porovnána s příslušnou právní úpravou ve Spolkové republice Německo.cs

dc.description.abstract-translatedThe thesis deals with the types of costs of civil litigation proceedings and the general obligation to pay them according to the basic civil procedural rules, as well as with the compensation of costs in the proceedings for the dissolution and settlement of co-ownership, which is classified in a special category of so-called iudicium duplex. The text of the thesis focuses firstly on the concept of costs, then on the list of the different types of costs in civil litigation and their analysis, then on the rules according to which the right to compensation of costs is decided, the compensation of costs in proceedings for the dissolution and settlement of co-ownership and a comparison of the presumed impact on the decision on costs in this type of proceedings with regard to the proposed diction of the Civil Procedure Code. The legal issues in question are also compared with the relevant legislation in the Federal Republic of Germany.en
