dc.description.abstractSmyslem diplomové práce bylo poukázat na detailní zakotvení institutů amnestie prezidenta a ústavní žaloby pro velezradu. Nechybí ani rozbor základního pojmosloví a uvedení čtenáře do historického kontextu těchto institutů. V části třetí je analyzována amnestie bývalého prezidenta republiky, publikovaná pod číslem 1/2013 Sb. Část čtvrtá je věnována ústavní žalobě pro velezradu, schválenou Senátem ČR nadpoloviční většinou v neveřejném hlasování.Práce se také zabývá nálezem Ústavního soudu Pl. ÚS 4/13, ve kterém Ústavní soud řízení zastavil. V části páté je pomocí komparační metody porovnána ústavněprávní úprava těchto dvou institutů v českém a německém právu.cs

dc.description.abstract-translatedThis dissertation aims to show the detailed position of the presidential amnesty institution and constitutional action for high treason. There is also analysis of the basic terminology and the historical context of these institutes. The amnesty of the former Czech president, published under number 1/2013 Sb., is analysed in the third part. Part four deals with the constitutional action for high treason approved by more than half members of the Upper Chamber of the Czech Parliament in a non-public vote. Also this dissertation looks into the finding of the Constitutional Court of the Czech republic Pl. ÚS 4/13 where this action was stopped by the Constitutional Court. Part five consists of comparison of these two institutions in the Czech and German law based on constitutional law, using comparative method.en
