Abstract: | Tato diplomová práce se zabývá postavením římské ženy v právu rodinném a v právu dědickém a charakterizuje, s jakými výhodami či omezeními se žena v římském právu mohla setkat. Práce obsahuje čtyři hlavní kapitoly, z nichž první se věnuje historickému exkurzu a přibližuje čtenáři život římských žen od narození až po smrt a pohřbívání. Druhá část stručně popisuje právní postavení, ve kterém se osoby mohly v římském právu nacházet, a dále podrobněji pojednává o pozici ženy, jakožto osoby sui iuris a alieni iuris. Největší důraz je kladen na postavení ženy v rámci římské rodiny a v právu upravujícím manželství, kterému se věnuje třetí část a neopomíjí ani mimomanželské formy soužití (konkubinát a kontubernium). Čtvrtá část je zaměřena na právo dědické, v rámci něhož je zkoumáno postavení žen s důrazem kladeným na genderové rozdíly. |
Abstract in different language: | The thesis deals with the legal status of Roman women in the family law and the law of succession and analyzes the advantages and restrictions of women's position in Roman law. The thesis conatains four main chapters, the first one includes the historical view of the Roman women's life from their birth to death and the burial ceremonies. The second part briefly describes the legal status of persons in Roman law and provides more detailed characteristics of women sui iuris and alieni iuris. The greatest attention is paid to the institute of marriage and the status of woman within the family law in general. The third part does not ommit to mention non-marital relationships, i.e. concubinage and contubernium. The fourth part is focused on the law of succession, the position of women in this branch of law where the inequality of sexes is highlighted. |
