| Abstract: | Cílem diplomové práce bylo především vytvořit ucelený přehled o současné právní úpravě, která se týká vydědění a ochrany nepominutelných dědiců. Práce je rozdělena do tří hlavních kapitol: Nepominutelný dědic, Vydědění, Ochrana nepominutelného dědice. V první kapitole se zabývám osobou nepominutelného dědice. Podávám výklad o tom, kdo je nepominutelným dědicem, jaké je jeho postavení a jak se do tohoto postavení osoba dostává. Druhá kapitola pojednává o vydědění. Tato kapitola je zaměřena na to, co je vydědění, koho lze vydědit a jakými způsoby, popis podmínek prohlášení o vydědění, definování důvodů vydědění a jejich charakteristiky a také jejich podmínky. Poslední kapitola je věnována ochraně nepominutelného dědice. Tato kapitola je zaměřena na povinný díl a další práva náležející nepominutelným dědicům. |
| Abstract in different language: | The main goal of this thesis is to provide a comprehensive overview of the current legislation concerning disinheritance and protection of forced heirs. The thesis is divided into three main chapters: Forced Heir, Disinheritance, Protection of Forced Heir. The first chapter deals with forced heirs, focuses on who a forced heir is, what their position is and how one becomes a forced heir. The second chapter describes disinheritance. This chapter focuses on what disinheritance is and who and how may be disinherited, describing essentials of declaration of disinheritance, defining legal grounds for disinheritance and their characteristics as well as conditions. The last chapter is dedicated to the protection of a forced heir. This chapter focuses on the forced share and other rights of forced heirs. |
