| Abstract: | Diplomová práce se zabývá institutem dohody o vině a trestu, která byla do českého právního řádu zavedena v roce 2012. Nejdříve jsou stručně uvedeny informace o historii a vývoji tohoto institutu, zásadách spojenými s dohodou o vině a trestu a následně je velká část diplomové práce věnována současné právní úpravě. Pozornost je též věnována významu dohody o vině a trestu. Dále je též pozornost věnována právní úpravě Slovenska a též srovnání aplikačního využití na území České republiky a Slovenska. V kapitole De lege ferenda jsou pak navrhnuty některé úpravy institutu dohody o vině a trestu, které je potřeba učinit, aby mohl být tento institut v praxi častěji využíván. |
| Abstract in different language: | This diploma thesis deals with the problematic of plea bargaining, that has been implemented into the legal code in 2012. The beginning of the thesis is dedicated to the focus on the history of plea bargaining. Therefore, a significant part of this thesis is dedicated to the legislation in the Czech Republic, which can be in many ways compared with the legislation in Slovakia. Based on the statistics mentioned in chapter 5, it is clear that this institute in Slovakia works very well and is often used as a tool for speeding up criminal proceedings and saving financial costs.These pros and cons that are the core of plea bargaining in the Czech Republic are covered in the chapter 4. However, there has to be legislation of Procedure Criminal Code that has been outlined in the chapter De lege ferenda. |
