| Abstract: | Diplomová práce na téma "Adhezní řízení" se zabývá možností poškozeného požadovat náhradu způsobené újmy, již v rámci trestního řízení. Celkově tato práce představuje provázanost trestněprávní úpravy s úpravou občanskoprávní. Stěžejní kapitola je věnována tragickým silničním dopravním nehodám a následnému uplatnění nároků pozůstalých na náhradu jim způsobené újmy. Podrobněji je v diplomové práci specifikován jeden z dílčích nároků na náhradu nemajetkové újmy, a to náhrada při usmrcení, včetně komparace předešlé a aktuální právní úpravy tohoto nároku, nastavení základní částky pro odškodnění, kritéria pro její zvýšení či snížení a srovnání vybraných soudních rozhodnutí. V závěru diplomové práce jsou shrnuty získané poznatky, zhodnocena vhodnost aktuální právní úpravy náhrady při usmrcení a navrženy možné změny právní úpravy do budoucna. |
| Abstract in different language: | This thesis deals with the possibility of the injured party, to claim compensation for caused detriment, already in the criminal proceedings. Overall, this thesis represents the interconnection of criminal law with civil law. The main chapter is devoted to tragic road accidents and the subsequent assertions of survivors' claims for detriment caused to them. The thesis examine in detail one of the particular claims arising in connection with the non-pecuniary harm, namely the compensation for death, including the previous comparison and current legal regulation of this claim, setting the basic amount of the compensation, criteria for its increase or decrease and comparison of selected court decisions. The conclusion of the thesis summarizes the acquired knowledge, evaluates the suitability of the current legal regulation of compensation for killing and suggests possible changes to the legal regulation in the future. |
