| Abstract: | Práce je zaměřená na současnou právní úpravu trestného činu vraždy. První část práce je zaměřena na vývoj české právní úpravy trestného činu vraždy. Těžištěm je podrobný rozbor vraždy z hlediska jednotlivých znaků skutkové podstaty, trestání, a komparace s ostatními trestnými činy proti životu. Opomenuty nejsou ani instituty, které s trestným činem souvisejí - nutná obrana, omyl a trestný čin opilství. Práce je prokládaná judikaturou českých trestních soudů, a také mými náměty de lege ferenda. |
| Abstract in different language: | The thesis focuses on the current legal regulation of the crime of murder. The first part of the thesis focuses on the development of the Czech legal regulation of the crime of murder. The focus is on a detailed analysis of murder in terms of individual features of the offence, punishment, and comparison with other crimes against life. The institutes related to the crime - necessary defence, mistake and the offence of drunkenness - are not omitted. The work is interspersed with the case law of Czech criminal courts, as well as my suggestions de lege ferenda. |
