| Abstract: | Tato diplomová práce se zabývá problematikou vybraných aspektů trestní odpovědnosti právnických osob v České republice. Práce v prvních částech pojednává v obecné rovině o teoretickém konceptu trestní odpovědnosti právnických osob, zejména se zaměřením na argumenty pro a proti zavedení institutu trestní odpovědnosti právnických osob. V další části následuje nejstěžejnější oblast této diplomové práce, kde věnuji detailní pozornost vybraným ustanovením zákona č. 418/2018 Sb. V důsledku analýzy de lege lata se v práci následně věnuji úvahám de lege ferenda, ovšem pouze ve vztahu k vybraným aspektů zákona č. 418/2011 Sb. V neposlední řadě se práce v dalších kapitolách do určité míry věnuje právním úpravám vybraných evropských států. |
| Abstract in different language: | This thesis deals with selected aspects of criminal liability of legal entities in the Czech Republic. The work in the first parts deals in general with the theoretical concept of criminal liability of legal persons, especially with focus on the arguments for and against the introduction of the institute of criminal liability of legal persons. The next part is followed by the most important area of this thesis, where I pay close attention to selected provisions of Act No. 418/2018 Coll. As a result of the de lege lata analysis, they pay more attention on de lege ferenda, but only in relation to selected aspects of Act No. 418/2011 Coll. Last but not least, the work in other chapters deals to some extent with the legal regulations of selected European countries. |
