| Abstract: | Cílem diplomové práce je nalézt vlivy římského práva v aktuálním občanském zákoníku pro oblast koupě a prodeje. První kapitola diplomové práce zvaná Římskoprávní prameny v moderních kodifikacích, se zabývá především problematikou recepce římského práva. V kapitole následující se již autorka věnuje samotné římské smlouvě trhové a jejímu původu. A následně i veškerým nezbytným náležitostem této smlouvy. Následuje část jež se zabývá kupní smlouvou v aktuálním občanském zákoníku a též rozebírá veškerá nezbytné aspekty kupní smlouvy. V kapitole poslední pak autorka porovnává oba tyto kontrakty a dosahuje tak cíle této diplomové práce. |
| Abstract in different language: | The aim of this thesis is to find influences of Roman law in the current Civil Code for the area of purchase and sale. The first chapter of the thesis called Roman Law Sources in Modern Codifications deals mainly with the reception of Roman law. In the next chapter, the author already deals with the Roman Treaty of the market itself and its origin. And then all the essentials of this contract. The following section deals with the purchase contract in the current Civil Code and also analyzes all the necessary aspects of the purchase contract. In the last chapter, the author compares both these contracts and thus achieves the objectives of this thesis. |
