| Abstract: | Tématem této diplomové práce jsou vybrané aspekty odposlechu a záznamu telekomunikačního provozu. Odposlech a záznam telekomunikačního provozu představuje důležitý nástroj při odhalování závažné trestné činnosti. Cílem této práce je podat komplexní výklad jak o právní úpravě odposlechu dle trestního řádu, tak o odposleších prováděných podle jiných zákonů, jakož i o záznamech pořízených soukromými osobami. Pozornost je věnována problematickým aspektům právní úpravy odposlechu, jakož i judikatuře českých soudů a Evropského soudu pro lidská práva. Samostatná kapitola nabízí srovnání současné německé a české právní úpravy odposlechu a záznamu telekomunikačního provozu. |
| Abstract in different language: | The topic of this thesis is "Selected Aspects of Wiretapping and Interception of Telecommunications". Wiretapping and interception of telecommunications represents an important tool for detecting serious crime. This thesis aims to provide a comprehensive interpretation of the current legislation on wiretapping under the Criminal Procedure Code, as well as the current legislation under other laws and private recordings with a deeper focus on problematic aspects and with regard to the law of both Czech courts and the European Court of Human Rights. The thesis also offers a comparison of the current German and Czech legislation on wiretapping and interception of telecommunications. |
