| Abstract: | Tato diplomová práce pojednává o veřejných strážích v právu životního prostředí. Po prvotní definici těchto stráží, popisuje tato práce jejich historický vývoj a důvod vzniku. Následně komplexně popisuje každou veřejnou stráž zvlášť, tzn. rybářskou stráž, mysliveckou stráž, lesní stráž a stráž přírody. V práci je kladen důraz na komparaci rozdílných právních úprav a jejich analýzu. Dále tato práce nabízí řešení škody vzniklé při výkonu činnosti veřejných strážců a detailně rozebírá jejich postavení v právním řádu. Následně je provedena komparace s právní úpravou na Slovensku a s neúspěšným vládním návrhem, který počítal s vytvořením jednotné stráže pro všechny oblasti. Následně je provedeno hodnocení a návrhy, které nastiňují možnou budoucí úpravu veřejných stráží. |
| Abstract in different language: | This diploma thesis deals with public guards in environmental law. After the initial definition of these guards, this work describes their historical development and the reason for their creation. Subsequently, it comprehensively describes each public guard separately, it means fishing guard, hunting guard, forest guard and nature guard. The thesis emphasizes the comparison of different legal regulations and their analysis. Furthermore, this thesis offers a solution to the damage incurred in the performance of the activities of public guards and analyzes in detail their position in the legal order. Subsequently, a comparison is made with the legislation in Slovakia and with the unsuccessful government proposal, which counted on the creation of a single guard for all areas. Finally, an evaluation and proposals are made suggesting the possible future modification of public guards. |
