Abstract: | Diplomová práce se zabývá rozhodovací praxí soudů ve věcech rodinných, kdy zkoumaným aspektem je vliv nepřípustnosti dovolání v některých rodinných věcech na judikaturu obecných soudů a s tím spojená zákonná úprava dovolání. Rozhodovací praxe soudů je zkoumána prostřednictví analýzy a komparace judikatury krajských soudů ve věcech péče o nezletilé, výživy nezletilých a styku s nezletilými. V rámci toho je anylyzována i judikatura Ústavního soudu v těchto věcech a její vliv na rozhodování krajských soudů. Hlavním cílem práce je odpovědět na otázky, zda nepřípustnost dovolání ovlivňuje jednotnost judikatury obecných soudů a zda je v tomto kontextu současná právní úprava vyhovující. |
Abstract in different language: | The diploma thesis deals with the decision-making practice of courts in family matters, where the examined aspect is the influence of inadmissibility of extraordinary appeal in some family matters on the case law of general courts and the related legal regulation of extraordinary appeal. The decision-making practice of the courts is examined by analysing and comparing the case-law of the regional courts in matters of custody of minors, maintenance of minors and contact with minors. The case law of the Constitutional Court in these matters and its influence on the decision-making of the regional courts is also analysed. The main objective of the thesis is to answer the questions whether the inadmissibility of extraordinary appeal affects the uniformity of the case law of the general courts and whether the current legislation is satisfactory in this context. |
