Abstract: | Tato diplomová práce se zabývá postojem stálých členů Rady bezpečnosti Organizace spojených národů (RB OSN) k humanitárním intervencím po přijetí doktríny Responsibility to Protect. Studie využívá přístupu vícepřípadové studie zaměřené na vybrané případy hrubého porušování lidských práv a zločinů proti lidskosti. Konkrétně se zabývá libyjskou občanskou válkou v roce 2011 a syrskou občanskou válkou v letech 2014-2016. Práce poskytuje stručný přehled sociopolitického kontextu obou konfliktů a relevantních rezolucí RB OSN a následně analyzuje záznamy jednání RB OSN, se zaměřením na vyjádření stálých členů RB OSN ohledně humanitárních intervencí. Práce dochází k závěru, že postoj západních stálých členů RB OSN k humanitárním intervencím je v souladu s definicí suverenity poskytnutou doktrínou Responsibility to Protect, která poskytuje ospravedlnění pro zásahy do vnitřních záležitostí jiných států, zatímco ruský a čínský postoj k humanitárním intervencím je negativní, neboť stále vnímají suverenitu podle vestfálského pojetí, který není humanitárním intervencím nakloněn. |
Abstract in different language: | The aim of this thesis is to examine the stance of the permanent members of the United Nations Security Council (UNSC) towards humanitarian interventions following the adoption of the Responsibility to Protect doctrine. The study uses a multi-case analysis approach focusing on selected cases of gross human rights violation and crimes against humanity. Specifically, it examines the Libyan civil war in 2011 and the Syrian civil war in 2014-2016. It provides a brief overview of the socio-political context of both conflicts and relevant resolutions of the UNSC. Subsequently, the thesis analyses UNSC meeting records, focusing on the arguments articulated by state representatives regarding humanitarian interventions. Overall, the thesis concludes that the stance of the Western permanent members of the UNSC towards humanitarian interventions is in line with the definition of sovereignty provided by the R2P doctrine, which provides a justification to intervene in the internal affairs of other states, while Russian and Chinese stance is negative, as they still perceive sovereignty according to the Westphalian concept, which is not in favor of humanitarian interventions. |
