| Abstract: | Žaloba proti rozhodnutí správního orgánu představuje účinný prostředek ochrany veřejných subjektivních práv fyzických a právnických osob před rozhodovací činností veřejné správy. Diplomová práce se zabývá řízením o takové žalobě v podmínkách českého správního soudnictví. Rozebrány jsou nejpodstatnější aspekty problematiky žaloby a řízení o ní, přičemž se vychází z platné právní úpravy, jíž je zákon č. 150/2002 Sb., soudní řád správní. Počáteční část práce uvádí čtenáře do problematiky správního soudnictví a vymezuje smysl žaloby proti správnímu rozhodnutí. Při rozboru žalobní legitimace je analyzováno, kdo může žalobu podat, co je oním správním aktem, který lze žalobou napadnout a čeho se lze u soudu domáhat. Následně se práce zabývá případy nepřípustnosti žaloby. Kapitola další popisuje náležitosti žaloby a lhůtu pro její podání. Problematiku odkladného účinku není opomenuta. Pokračuje se soudním přezkumem napadeného rozhodnutí, včetně soudního jednání a dokazování. V poslední kapitole jsou naznačeny všechny možné způsoby skončení řízení, tedy odmítnutí žaloby, zastavení řízení a rozhodnutí ve věci samé. V závěru práce jsou mimo jiné zmíněny některé nedostatky současné úpravy a jejich možné řešení. |
| Abstract in different language: | The most effective possibility of defence for anyone whose has been prejudiced directly or due to the violation of his or her rights in the proceedings procedure by an administrative act is to take an action againts it. This diploma thesis deals with the procedure on complaint against a decision of an administrative authority. It has been written according to existing Czech legal regulation, which is especially the Act No. 150/2002, Code of Administrative Justice. The aim of this thesis is to analyze all important aspects of the procedure, from its beginning to its end. Before the thesis focuses on the procedure itself, firstly concentrates briefly to developtment of regulation of the administratice judiciary. Then features basic principles, which this judiciary and proceedings are built on. Chapter called Complaint legitimation tries to explain who has the right to sue, who is the administrative body and what is the meaning of term administrative decision or administrative act. Next chapter called Inadmissibility of a complaint analyze all the reasons, why the complaint is not acceptable by the court. In following chapter are mentioned elements of compliant and the time limit for filling a compliant. In the next chapter is explored the hearing of compliant and the possibilities to decide without the hearing. Seriously payed attention is for review of the contested decision. It is explained what means illegality of an administrative acts and it is compared to meaning of procedural faults. Last chapter called Decision on the merits deals with all ways which the procedure can ends for. The conclusion of this thesis contains some ideas how to change existing regulation. Of course, there is a briefly summary of important results of this diploma thesis. |
