| Abstract: | Diplomová práce se zabývá institutem nutné obrany v České republice a Spolkové republice Německo. Zmiňuje základní myšlenky nutné obrany v obou těchto zemích a nastiňuje krátkým historickým exkursem vznik a následný vývoj pojetí institutu nutné obrany. Zvláštní pozornost je věnována zejména rozboru jednotlivých znaků a podmínek nutné obrany jak z hlediska teoretických východisek, tak i konkrétních právních úprav. Těžištěm jejího zkoumání je pojetí nutné obrany v českém a německém právu. Dále navazuje komparace, která se věnuje srovnání jednotlivých znaků, rysů, prvků a zejména pojetí nutné obrany v právních systémech obou zemí, vyzdvihuje jejich slabé i silné stránky a v neposlední řadě nastiňuje úvahy de lege ferenda. |
| Abstract in different language: | The diploma thesis deals with the institute of necessary defense in the Czech Republic and the Federal Republic of Germany. It mentions the basic ideas of the necessary defense in both of these countries and outlines a short historical excursion to the origin and subsequent development of the concept of the necessary defense institute. Special attention is paid to the analysis of individual features and conditions of the necessary defense both in terms of theoretical background and specific legislation. The focus of its research is the concept of necessary defense in Czech and German law. Furthermore, a comparison is made, which compares the individual features, traits, elements and especially the concept of necessary defense in the legal systems of both countries, highlights their strengths and weaknesses and, last but not least, outlines de lege ferenda considerations. |
